Payments made through our website may be processed by third-party payment service providers, including PayU, or other payment partners used by AARKA from time to time.

AARKA does not intend to store complete debit-card, credit-card, banking, UPI, or other sensitive payment credentials on its own systems where those details are processed directly by the relevant payment provider.

Payment providers may collect and process information according to their own privacy policies, security practices, and applicable legal requirements.

For payment-related concerns, please also review the applicable terms of the relevant payment provider.

We use your information to process and fulfil your order.

This may include verifying an order, confirming payment, arranging dispatch, coordinating delivery, providing tracking information, communicating about delivery attempts, handling cancellations, processing returns or refunds, and providing warranty or after-sales assistance.

Where necessary, relevant order information may be shared with third-party logistics, courier, technology, payment, communication, or other service providers who assist us in providing these services.

Such information is shared only to the extent reasonably necessary for the relevant business purpose and subject to applicable law.

5. PRESCRIPTION AND CUSTOM LENS INFORMATION

We may use information collected from you to process orders, provide products and services, communicate with you about your order, provide customer support, respond to enquiries, verify transactions, prevent misuse or fraudulent activity, arrange shipping and delivery, process cancellations, returns, refunds and warranty claims, improve our website and customer experience, maintain business records, comply with legal obligations, and protect the rights, property, and security of AARKA, our customers, and our service providers.

Where permitted by applicable law and where appropriate consent is required, we may also use your contact information to send product updates, offers, launches, or other marketing communications.

You may opt out of non-essential marketing communications at any time using the available unsubscribe mechanism or by contacting us.

7. CUSTOMER COMMUNICATIONS

When you place an order or contact AARKA, we may communicate with you using the contact details you provide.

Depending on the purpose and available service, communications may be sent through email, WhatsApp, SMS, telephone calls, or other appropriate channels.

These communications may include order confirmations, payment updates, shipping and tracking information, delivery-related communication, cancellation or return updates, warranty communication, customer-support responses, and other service-related information.

Service-related communications may continue even if you have opted out of promotional communications because they may be necessary to complete or support your transaction.

AARKA may use WhatsApp or other third-party communication services to communicate with customers.

When you communicate with us through such services, the information exchanged may also be processed by the relevant service provider according to its own terms and privacy practices.

AARKA does not control the privacy practices, security systems, or policies of third-party communication platforms.

Customers should therefore review the privacy policies of such platforms where appropriate.

9. COOKIES AND WEBSITE TECHNOLOGIES

Our website may use cookies and similar technologies to provide essential website functionality, remember preferences, understand website usage, improve performance, maintain security, and support relevant website or marketing activities.

Cookies are small files or pieces of information stored on your device by a website or associated technology.

Some cookies may be essential for the website to function correctly, while others may help us understand how visitors interact with our website.

You may be able to manage or restrict cookies through your browser or device settings. However, disabling certain cookies may affect some website functionality.

Where required by applicable law, AARKA will seek appropriate consent for non-essential cookies or similar technologies.

10. WEBSITE AND TECHNICAL INFORMATION

When you visit our website, certain technical information may be collected automatically by our website, hosting provider, analytics tools, security systems, or other technology services.

This may include information such as IP address, browser type, device information, operating system, approximate location derived from technical information, pages visited, referring pages, access times, and general website interaction information.

We may use this information to operate, secure, troubleshoot, analyse, and improve our website and services.

We do not use such technical information to identify you personally unless reasonably necessary for security, fraud prevention, legal compliance, customer support, or another legitimate purpose.

11. FRAUD PREVENTION AND ORDER VERIFICATION

To protect our customers and AARKA from unauthorized transactions, misuse, fraudulent orders, payment abuse, or other suspicious activity, we may verify information associated with an order.

This may include confirming customer details, order information, payment status, delivery information, or other information reasonably necessary to establish that an order is genuine and authorized.

Where an order cannot reasonably be verified or appears suspicious, AARKA may delay, hold, or cancel the order in accordance with our Terms of Use & Purchase and Order Cancellation Policy, subject to applicable law.

We may retain records relating to suspected fraud or misuse where reasonably necessary to protect our business, customers, payment systems, or legal interests.

12. WHEN WE MAY SHARE YOUR INFORMATION

AARKA does not sell your personal information as a standalone commercial product.

We may share information with trusted third parties where reasonably necessary to operate our business and provide services to you.

These may include payment processors, courier and logistics partners, technology and hosting providers, website service providers, customer-support or communication platforms, analytics or security service providers, professional advisers, and government, regulatory, law-enforcement, or judicial authorities where disclosure is required or permitted by law.

Third-party service providers generally receive only the information reasonably necessary for the service they are providing.

Where appropriate, AARKA expects service providers handling customer information to maintain reasonable safeguards and use such information only for the relevant business purpose.

13. BUSINESS TRANSFERS

If AARKA undergoes a business restructuring, merger, acquisition, sale of assets, change of ownership, or similar business transaction, customer information may be transferred as part of the relevant business assets or operations, subject to applicable law and appropriate safeguards.

Any such transfer will not reduce the privacy protections applicable to your information beyond what is legally permitted.

14. DATA SECURITY

We take reasonable measures to protect personal information against unauthorised access, misuse, alteration, loss, disclosure, or destruction.

These measures may include access controls, secure technology systems, authentication procedures, contractual controls with service providers, and other reasonable administrative, technical, and organizational safeguards.

However, no internet transmission or electronic storage system can be guaranteed to be completely secure.

Accordingly, while we take reasonable steps to protect your information, we cannot guarantee absolute security against every possible threat.

15. HOW LONG WE RETAIN INFORMATION

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including order fulfilment, customer support, returns, refunds, warranties, accounting, tax, fraud prevention, dispute resolution, legal compliance, and legitimate business record-keeping.

The appropriate retention period may vary depending on the type of information and the reason for retaining it.

When information is no longer reasonably required, we may delete, anonymize, or securely dispose of it, subject to applicable legal, regulatory, accounting, or operational requirements.

16. YOUR PRIVACY CHOICES AND RIGHTS

Subject to applicable law, you may have rights regarding your personal information, including the ability to request access to certain information, correction of inaccurate information, deletion or erasure where legally available, withdrawal of consent where processing is based on consent, and information regarding how your personal information is handled.

You may also request that we stop sending non-essential promotional communications.

Some requests may not be capable of being fulfilled immediately or completely where retaining or processing information is required or permitted by law, necessary for a transaction, required for fraud prevention, needed to establish or defend legal claims, or otherwise justified under applicable law.

To make a privacy-related request, contact us at team@aarkaeyewear.com.

We may need to verify your identity or order details before acting on a request, particularly where the request involves access, correction, deletion, or disclosure of personal information.

17. WITHDRAWAL OF CONSENT

Where AARKA relies on your consent for a particular processing activity, you may withdraw that consent by contacting us, subject to applicable law.

Withdrawal of consent will not affect processing that was lawfully carried out before the withdrawal.

It may also not be possible to withdraw consent where processing is necessary for purposes that do not depend on consent, such as fulfilling an order, complying with legal obligations, preventing fraud, or establishing or defending legal claims.

18. CHILDREN’S PRIVACY

Our website and services are intended for general consumers and are not knowingly directed toward children in circumstances where applicable law requires parental or guardian consent.

We do not knowingly seek to collect unnecessary personal information from children.

If you believe that a child has provided personal information to AARKA in circumstances where such collection was not appropriate, please contact us so that we can review the matter and take appropriate action.

19. THIRD-PARTY WEBSITES AND SERVICES

Our website or communications may contain links, integrations, payment options, social-media features, or other connections to third-party websites and services.

Once you leave AARKA’s website or interact directly with a third-party service, that third party’s own privacy policy and terms may apply.

AARKA is not responsible for the privacy practices, security, content, or policies of third-party websites or services that we do not control.

20. INTERNATIONAL PROCESSING

Some of our technology, payment, communication, analytics, hosting, logistics, or other service providers may process information outside India or through infrastructure located in another jurisdiction.

Where personal information is processed outside India, AARKA will take steps required by applicable law and applicable contractual or organisational safeguards.

By using our website and services, you acknowledge that information may be processed by relevant service providers in accordance with their legitimate business functions and applicable law.
